These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and DPDP Compliance Hub ("Platform", "we", "us", or "our").

By accessing or using this website, its structured statutory readers, interactive assessment calculators, practical guides, policy templates, or API endpoints, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must discontinue use of the platform immediately.

You should not act or refrain from acting on the basis of any content included on this website without seeking appropriate legal, regulatory, and information security counsel licensed in India.

DPDP Compliance Hub is an independent, privately created educational portal. We are NOT affiliated with, sponsored by, endorsed by, or operated on behalf of:

• The Government of India;
• The Ministry of Electronics and Information Technology (MeitY);
• The Ministry of Law and Justice (Legislative Department); or
• The Data Protection Board of India (DPBI).

While our team strives to maintain accurate and up-to-date legal mappings:

• Scores are Estimates: Readiness scores, risk classifications (e.g. Green / Amber / Red), and checklist percentages generated by our tools are heuristic educational estimations, not statutory audits.
• No Safe Harbor: Achieving a high readiness score or utilizing our generated templates does not confer legal immunity, safe harbor, or guarantee compliance in inquiries conducted by the Data Protection Board of India or Indian courts.

When utilizing our 16 interactive tools or downloading policy templates (e.g. Privacy Notices, DPAs, RoPA logs, DPIA templates):

1. Starting Drafts Only: Generated documents and templates are foundational starting drafts that must be customized and validated by qualified legal counsel to reflect your specific data flows and sector regulations (e.g. RBI, SEBI, IRDAI, TRAI norms).
2. Stateless Execution: We process your tool questionnaire inputs statelessly in memory without saving responses to our persistent database. You are responsible for exporting and preserving any generated outputs.

Permitted Uses:

• Internal organizational education, gap evaluation, and workflow preparation;
• Academic, legal, and privacy research regarding India's data protection regime;
• Downloading and adapting templates for legitimate internal enterprise compliance programs.

Prohibited Uses:

• Automated Mass Scraping: Deploying automated crawlers, bots, or scrapers that place unreasonable or disproportionate loads on our infrastructure;
• Commercial Reselling: Packaging, selling, or sublicensing our proprietary tool interfaces, software code, or compilation database for commercial gain without explicit written consent;
• Security Tampering: Attempting to probe, scan, breach, or bypass authentication or rate-limiting safeguards;
• Misrepresentation: Misrepresenting platform scores or outputs as official government-certified compliance certificates.

We respect intellectual property rights and demarcate platform rights as follows:

• Statutory Legislation (Public Domain): The verbatim text of the Digital Personal Data Protection Act, 2023 and official Gazette Rules are public government works and are not subject to copyright.
• Platform IP (Protected): The proprietary software code, database architecture, UI/UX design, visual assets, original editorial articles, explanatory guides, and interactive tool logic are the exclusive intellectual property of DPDP Compliance Hub and protected by applicable copyright and trademark laws.

To maintain legislative transparency, our database retains historical iterations, superseded draft rules, and previous versions of statutory provisions. Archived records are designated with clear status badges and should not be relied upon as representing current in-force statutory law.

This platform contains hyperlinks to external portals operated by the Government of India, MeitY, eGazette, and other third parties. These links are provided solely for convenience and source traceability. We exercise no editorial control over external domains and disclaim liability for their availability, accuracy, or content.

THE PLATFORM, ITS CONTENT, TOOLS, GUIDES, AND TEMPLATES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR COMPLIANCE OBJECTIVE, STATUTORY ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED AVAILABILITY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, IN NO EVENT SHALL DPDP COMPLIANCE HUB, ITS OPERATORS, AUTHORS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, STATUTORY FINES IMPOSED BY THE DPBI, BUSINESS INTERRUPTION, LOSS OF DATA, OR LEGAL DEFENSE COSTS) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO, USE OF, OR INABILITY TO USE THIS WEBSITE OR ITS RESOURCES.

You agree to defend, indemnify, and hold harmless DPDP Compliance Hub, its operators, and team members from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable legal fees) resulting from your violation of these Terms or misuse of platform resources.

These Terms and any disputes arising out of or related to this platform shall be governed by and construed in accordance with the laws of the Republic of India, without giving effect to any conflict of law principles. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the competent courts of India.

We reserve the right to modify or amend these Terms at our sole discretion. Continued use of the platform following the posting of revised Terms constitutes your acceptance of the changes.
